By joining Clap House The Wellness Club, you confirm that you have read, understood, and accepted the following membership terms.
01Membership Access
Membership access is personal, individual, and non-transferable.
Your QR code, biometric access, membership profile, pass, or access credential may only be used by you. Sharing access with another person is not permitted and may result in suspension or cancellation of your membership without refund.
Clap House reserves the right to request identification at any time to verify membership access.
02Club Conduct
Members agree to respect the calm, privacy, and wellbeing of the club and its guests.
You agree to:
- Treat staff, members, and guests with respect
- Use the facilities safely and responsibly
- Keep noise, phone calls, and music at a respectful level
- Follow staff instructions at all times
- Respect pool, spa, gym, treatment, and recovery area rules
- Maintain proper hygiene when using gym, spa, pool, and recovery facilities
- Avoid behaviour that may disturb, endanger, or inconvenience others
Clap House may refuse entry, suspend access, or cancel a membership if a member behaves in a way that is unsafe, abusive, disruptive, or inconsistent with the atmosphere of the club.
03Bookings and Cancellations
Certain services, classes, treatments, sunbeds, cabanas, training sessions, and wellness experiences may require advance booking.
Bookings may be cancelled up to two hours in advance without charge.
Late cancellations, missed bookings, or no-shows may result in a cancellation fee, loss of the booked session, or temporary booking restrictions.
Clap House may update cancellation windows for specific services, treatments, or events. Any updated cancellation policy will be shown at the time of booking.
04Payments and Unpaid Balances
Members are responsible for paying all membership fees, passes, treatments, services, extras, and any applicable charges linked to their account.
Clap House reserves the right to suspend or restrict access for unpaid balances, failed payments, chargebacks, or payment disputes.
Membership benefits, bookings, and access may be paused until the account is brought up to date.
05Membership Term, Renewal, and Cancellation
Your membership or pass is valid for the period selected at signup or purchase.
Memberships, passes, and packages may have different durations, benefits, renewal terms, and cancellation rules.
Unless clearly stated otherwise, prepaid memberships, passes, and packages are non-refundable once activated or used.
If your membership renews automatically, renewal terms, billing dates, and cancellation instructions will be displayed before purchase and in your member account.
06Right of Withdrawal
If you purchase a membership, pass, or package online, you may have a legal right to withdraw within the applicable consumer protection period, unless the service has already begun with your consent or another legal exception applies.
By activating your access, entering the club, booking a class, booking a treatment, or using any Clap House service during the withdrawal period, you acknowledge that the service has started and that any refund may be limited or unavailable depending on applicable law.
07Health and Safety
You confirm that you are physically able to use the gym, spa, pool, recovery areas, treatments, and wellness services.
You are responsible for consulting a doctor before using any facility or service if you have any medical condition, injury, pregnancy, heart condition, skin condition, respiratory condition, allergy, or any other health concern.
Use of the gym, sauna, steam room, cold plunge, hot plunge, ice baths, pool, recovery areas, and treatments is at your own risk.
You agree to stop using any facility immediately if you feel unwell, dizzy, faint, short of breath, or uncomfortable.
Clap House staff may refuse or stop access to any activity if they reasonably believe it may be unsafe.
08Personal Belongings
Members are responsible for their own belongings.
Clap House is not responsible for lost, stolen, or damaged personal items, except where required by law.
Members should use lockers or secure storage where available and avoid leaving valuables unattended.
09Facilities and Availability
Clap House aims to provide a premium wellness experience, but facilities, classes, treatments, pools, spa areas, equipment, restaurant services, kids corner, sunbeds, cabanas, and valet parking may vary by membership type, availability, season, capacity, maintenance, weather, private events, or operational needs.
Clap House may temporarily close or limit access to certain areas for safety, cleaning, repairs, events, improvements, or legal requirements.
10Guest Access and Invitations
Guest invitations are subject to the member's plan, availability, and club rules.
Guests must check in, follow club rules, and may be required to complete a guest waiver or registration before entry.
Members are responsible for the behaviour of their guests.
Guest access is not guaranteed and may be restricted during busy periods, private events, or at the discretion of the club.
11Kids Corner
Kids Corner access is subject to availability, age rules, opening hours, supervision requirements, and safety policies.
Parents or guardians remain responsible for their children at all times unless a separate supervised childcare service has been expressly confirmed.
Children must follow all club rules and may not enter restricted gym, spa, recovery, or pool areas unless permitted by staff.
12Photography and Privacy Inside the Club
Members must respect the privacy of others.
Photos and videos must not capture other members, guests, staff, children, treatment areas, changing rooms, bathrooms, or private spaces without permission.
Commercial photography, influencer shoots, brand shoots, and professional filming require prior written approval from Clap House.
13Data Protection (GDPR)
The data controller is Clap House, Talamanca, Ibiza (Spain). We process your personal data in accordance with the EU General Data Protection Regulation (GDPR) and Spanish data protection law (LOPDGDD). For any privacy question, or to exercise your rights, contact us at info@claphouse.co.
We process the following data, each on a clear lawful basis:
- Identity and contact details, membership status, payments, bookings, and access records — to perform your membership contract and meet our legal and accounting obligations.
- Your access credential and entry logs — on our legitimate interest in keeping the club secure and preventing fraudulent or shared access.
- Health information you choose to share (goals, injuries) — a special category of data we process only with your explicit consent, to tailor your sessions safely.
- Biometric access, if you opt in — a special category of data under Article 9 GDPR, used solely to identify you at entry and only with your separate explicit consent. A QR code is always offered as an alternative, so biometrics are never required.
- Marketing communications — only if you opt in, and you can withdraw consent at any time.
Your data is shared only with the processors needed to run the club (for example our payment provider, email and hosting providers) under data processing agreements; some may operate outside the EEA under the safeguards GDPR requires. We keep your data for the life of your membership and the period required by law, after which it is deleted or anonymised. We do not sell your data.
14Your data protection rights
Under the GDPR you may, at any time and free of charge, exercise the following rights over your personal data:
- Access a copy of the data we hold about you
- Rectify inaccurate or incomplete data
- Erase your data (the right to be forgotten), where applicable
- Restrict or object to certain processing
- Port your data to another provider
- Withdraw any consent you have given, without affecting prior processing
Email info@claphouse.co to exercise any of these rights. If you believe we have not handled your data properly, you have the right to lodge a complaint with the Spanish Data Protection Agency (Agencia Española de Protección de Datos, www.aepd.es).
15Changes to Terms
Clap House may update these membership terms from time to time.
If material changes are made, members will be notified through the app, website, email, or member account.
Continued use of the club after updated terms are provided means you accept the updated terms.
16Suspension or Termination
Clap House may suspend or cancel membership access if a member:
- Shares their access credential or QR code
- Has unpaid balances
- Misuses facilities
- Repeatedly misses bookings
- Behaves inappropriately toward staff, members, or guests
- Breaks safety rules
- Damages club property
- Violates these membership terms
17Acceptance
By continuing, you confirm that:
- You have read and accepted this Membership Agreement
- You understand that access is personal and non-transferable
- You agree to follow all club rules and staff instructions
- You accept the booking, cancellation, payment, health, safety, and privacy terms
- You understand that use of the facilities is at your own risk, except where liability cannot legally be excluded
